A sizing or fit preference does not constitute a product defect.

4. GRAPHIC TEES AND PRINTED APPAREL

Some Southern Darling TX graphic tees and apparel may be printed or finished in-house.

Because certain items may be produced individually, minor variations in print placement, sizing, color, or appearance may occur. These small variations are a normal part of the production process and do not necessarily constitute a defect.

Customers should follow the care instructions provided with or listed for their apparel to help preserve the garment and design.

5. CUSTOM AND PERSONALIZED ITEMS

Custom and personalized products are made specifically according to the information submitted by the customer.

Customers are responsible for reviewing all names, spelling, wording, sizes, colors, and other personalization details before submitting an order.

Southern Darling TX is not responsible for errors resulting from incorrect personalization information submitted by the customer.

Custom and personalized items are final sale and cannot be returned, exchanged, refunded, or issued store credit, except when Southern Darling TX has made an error or as otherwise required by applicable law.

6. PRICING

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, product availability, and other offers are subject to change without notice.

We reserve the right to correct pricing errors, typographical errors, product information errors, or other inaccuracies.

If an obvious pricing or listing error affects an order, we may contact you regarding the error and, where permitted, cancel and refund the affected order.

7. DISCOUNTS AND PROMOTIONS

Discount codes and promotions are subject to any terms stated with the offer.

Unless otherwise stated, discounts:

Cannot be combined with other promotional offers
Cannot be applied to previous purchases
Have no cash value
May exclude certain products or collections
May expire or be discontinued according to the terms of the promotion

Southern Darling TX reserves the right to cancel or modify promotions when reasonably necessary, subject to applicable law.

8. ORDERS

We reserve the right to refuse, limit, or cancel an order where reasonably necessary, including suspected fraud, unauthorized transactions, pricing or inventory errors, or violations of these Terms.

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

Customers are responsible for providing complete and accurate billing, shipping, contact, and order information.

9. ORDER CHANGES AND CANCELLATIONS

We begin processing orders as quickly as possible.

If you need to request a change or cancellation, please contact us immediately. We cannot guarantee that an order can be changed or canceled once processing or production has begun.

Custom or personalized orders may not be canceled once production has started.

10. SHIPPING

Processing and shipping estimates are provided in good faith but are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Once an order has been transferred to the shipping carrier, delivery may be affected by circumstances outside Southern Darling TX’s direct control.

Customers are responsible for entering a complete and accurate shipping address when placing an order.

11. DAMAGED SHIPMENTS

Customers should inspect orders promptly upon delivery.

If an order arrives damaged, please contact us within the timeframe stated in our Return & Refund Policy and provide the requested photographs and information.

For packages shipped through USPS or another carrier, a carrier claim may need to be filed. Carrier claims and investigations can take time to process and are subject to the carrier’s procedures and determination.

Customers may be required to retain the merchandise, shipping container, labels, and all packaging materials while a claim is being reviewed.

12. RETURNS, STORE CREDIT AND FINAL SALE ITEMS

Eligible returns are governed by our separate Return & Refund Policy.

Eligible returns must be initiated within 7 days of the carrier-confirmed delivery date and are issued as store credit only, subject to the requirements of our Return & Refund Policy.

Certain merchandise is final sale, including:

Custom and personalized items
Swimwear
Earrings and other pierced jewelry
Last Chance and clearance merchandise
Gift cards
Products otherwise marked FINAL SALE

Final-sale items are not eligible for standard returns, exchanges, refunds, or store credit, except where required by law or where Southern Darling TX made an error or the product qualifies for another remedy under applicable law.

13. EXCHANGES

We often carry limited quantities of our styles and cannot guarantee exchanges.

If you need a different size, we recommend purchasing the desired size as a new order and initiating a return for the original eligible item. This provides the best opportunity to secure the desired size before it sells out.

The original item must still meet all eligibility requirements stated in our Return & Refund Policy. Once an eligible return has been received, inspected, and approved, store credit will be issued according to that policy.

14. GIFT CARDS AND STORE CREDIT

Gift cards and store credit may be used toward eligible purchases from Southern Darling TX.

Gift cards and store credit are not redeemable for cash except where required by applicable law.

Lost or stolen gift cards or store credit will be handled in accordance with applicable law and the capabilities of our ecommerce platform.

15. INTELLECTUAL PROPERTY

Unless otherwise stated, the Southern Darling TX name, branding, original graphics, photographs, website content, text, product imagery, and other original content created by or for Southern Darling TX are owned by or licensed to Southern Darling TX and/or Haley Eliza LLC.

You may not reproduce, copy, distribute, sell, modify, or commercially exploit our protected content without permission from the applicable rights holder.

Third-party names, brands, artwork, trademarks, and other intellectual property remain the property of their respective owners.

16. CUSTOMER PHOTOS, REVIEWS AND CONTENT

If you voluntarily submit a review, photograph, testimonial, tag, or other content to Southern Darling TX, you represent that you have the right to submit that content.

We will not claim ownership of your content solely because you submit it to us.

If we wish to use customer-created photographs or other content in advertising or marketing beyond functionality already authorized through the platform you used, we may request permission when appropriate.

Our website may use or link to third-party services, including payment processors, shipping carriers, social media platforms, apps, and other service providers.
